NOTICE REQUIRING PAYMENT OF RATES - SECTION 184, LOCAL GOVERNMENT ACT 1999 (SA)
DISTRICT COUNCIL OF CLEVE (“Council”), SOUTH AUSTRALIA
TO THE PERSON NAMED BELOW
TAKE NOTICE THAT:
You are the principal ratepayer appearing on the assessment records in respect of the land referred to below. Rates with respect to the said land have been in arrears for 3 years or more. The total amounts due and payable to the Council for rates (including fines and interest) charged on the land are shown below. The Council has also incurred legal costs in issuing and publishing these notices. Pursuant to section 184(11) of the Local Government Act 1999 (SA) ("the Act"), the Council is legally entitled to recover the costs of the sale and any other costs incurred in proceeding under section 184 of the Act from any sale proceeds following a sale of the land. Please note, there are likely to be more costs incurred by the Council in respect of moving forward with the foreshadowed sale of the land in the event there is a failure to comply with these notices.
PAYMENT of the rates in arrears referred to below and all continuing rates, fines, and interest IS HEREBY DEMANDED.
FURTHER TAKE NOTICE that if payment of the moneys demanded is not made within one (1) month, the land, or your interest in the land, will be offered for sale by public auction at a time appointed by the Council. Pursuant to section 184(9) of the Act if, before the date of such an auction, the outstanding amount and the costs incurred by the Council in proceeding under section 184 of the Act are paid to the Council, the Council must call off the auction.
