DECLARATION OF DESIGNATED AREA UNDER SECTION 10D(1)
Planned Operation in City of Port Phillip – St. Kilda Entertainment Precinct and Surrounds
The Assistant Commissioner, Transit and Public Safety Command, acting as a delegate of the
Chief Commissioner of Police, under section 10D(1) of the Control of Weapons Act 1990, declares
as a designated area all public places within the City of Port Phillip that are within the area bounded
by and including, from the intersection Acland Street and Barkly Street, along Acland Street
to the intersection of Carlisle Street, along Carlisle Street which continues into the Esplanade,
along the Esplanade to the intersection of Fitzroy Street, along Fitzroy Street to the intersection
of Balluk William Court (including the St Kilda light rail terminal), back along Fitzroy Street to
The Esplanade, along the Esplanade to Acland Street (including McDonald’s Restaurant), along
Acland Street to the intersection of Barkly Street. (Road has the same meaning as in section 3 of the
Road Safety Act 1986.)

This declaration will be in place from:
1700 hours on 31 December 2024 to 0500 hours on 1 January 2025
Please be advised that:
a declaration is in force pursuant to section 10D of the Control of Weapons Act 1990;
you and/or your vehicle is in a public place that is within a designated area;
police officers and protective services officers on duty at a designated place (as per the
Victoria Police Act 2013) are empowered to search you and anything in your possession
or control, or your vehicle for weapons;
it is an offence to obstruct or hinder a police officer or a protective services officer on duty
at a designated place in the exercise of a power to stop and search a person or a vehicle.
If a police officer or protective services officer on duty within a designated place intends
to conduct a limited search of you or your vehicle/things for weapons:
a. you are requested to co-operate with that search;
b. you may be requested to remove items of outer clothing such as headwear, scarves, jackets, etc;
c. you may be searched using an electronic wand;
d. you may be requested to remove items from any bags or pockets;
e. you may be given a ‘pat down’ search.
Whilst within the designated area, a police officer may request that you remove any face covering
if the police officer reasonably believes the face covering is being worn primarily to conceal your
identity, or to protect from the effects of crowd-controlling substances. If you refuse to remove the
face covering, the police officer may direct you to leave the designated area.
A police officer may also direct a person to leave a designated area if the police officer reasonably
believes the person intends to engage in conduct that would constitute an offence under section 195H
(affray) or 195I (violent disorder) of the Crimes Act 1958.
It is an offence to fail to comply with any direction to leave a designated area without reasonable
excuse.
