Notice of Intention to Seize and Remove Abandoned Property
Transport Operations (Marine Safety) Act 1994, section 175A

Date of notice: 31st of August 2024

I, Samuel Collins, am appointed as a Shipping Inspector under part 13 of the Transport Operations (Marine Safety) Act 1994 (the Act).

Description of abandoned property:
Weary Bay
1. Un-named and unregistered Gray hulled fiberglass, sailing trimaran approximately 10 meters in length. Vessel is in poor condition, unlit and the hulls have significant damage.
2. Remains of a 9m Fiberglass catamaran vessel with auto cancelled registration WI381Q

Cow Bay
3. Unknown 10m steel sailing vessel in poor and unseaworthy condition with the only the mast visible at high tide
4. Unknown 10m steel fishing vessel in poor condition and unseaworthy

Daintree River
5. 9m Timber/ GRP sailing vessel with expired New south Wales registration AHU280N
6. A 12m Half Cabin fibreglass vessel named CATN with auto cancelled registration ADX63Q and pontoon that is part attached.

Port Douglas
7. An 8m Full Cabin Yacht named Noahs Ark with auto cancelled registration RA514Q.
8. Timber planked 8.0m mono de-masted sailboat in poor condition with rotten plywood deck and rotten hull planking.
9. Partially submerged 7.5m fiberglass sailing vessel with a white hull and nil identifiable marks visible.
10. A 11.58m Full Cabin Ferro cement sailing vessel named YOHOHO with auto cancelled registration AZH69Q.

Cairns
11. Unknown submerged monohull which is believed to be a retired mackerel fishing vessel.

Where and when abandoned property was found:

Weary Bay
1. Aground on the beachfront of Weary Bay to the northern side of Bloomfield River located in approximate position 15°54.28°S 145°21.24E.
2. Located on the beachfront of Weary Bay to the northern side of Bloomfield River in approximate position 15°54.28°S 145°21.24E.

Cow Bay
3. The vessel is Located sunk in an unnamed creek in vicinity of Bailey Pt, Cow Bay in approximate position 16°12.16S, 145°26.53E.
4. The vessel is located at the mouth of an un-named creek in the vicinity of Bailey Pt, Cow Bay in approximate position 16°12.18S, 145°26.66E.

Daintree River
5. The vessel was found located sunk against the mangroves in the southern reach of the Daintree River with only the mast showing. in approximate position 16°17.3 S, 145°24.4E.
6. Currently located North Wonga beach south of Daintree in approximate position 16°18.10S 145°26.61E.

Port Douglas
7. Currently located sunk in tributary Packers Creek upstream starboard side second creek up at Port Douglas in approximate position 16°30.22 S 145°27.19E.
8. Dickson Inlet, Packers Creek upstream in the vicinity Barramundi Farm in approximate position 16°29.56 S, 145°27.10E.
9. Located on the bend of Packers Creek adjacent to the Marano’s Fuel Wharf in approximate position 16°29.35S – 145°27.33E.
10. Located on anchor at the bend of Packers Creek adjacent to the Marano’s Fuel Wharf in approximate position 16°29.34S – 145°27.35E. Cairns
11. Located sunk in the Admiralty Island buoy mooring grid – Cairns Harbour in approximate position 16°56.54S – 145°47.11E.

I reasonably believe the properties above to be abandoned.

When abandoned property may be seized and removed:
If the property described above is not claimed by 30th of September 2024 it may be seized and removed by Maritime Safety Queensland.

Statement for the purposes of section 175A (5) of the Act:
If no one claims the property within the time stated above and I seize and remove it, I may, having regard to the value and condition of the property and without further notice –
(a) sell the property by public auction; or
(b) destroy it.

If you wish to assert ownership in the property described above, you must attend in person to Maritime Safety Queensland, Field Operations Base, 100–106 Tingira Street, Portsmith, Cairns, 4870 in the State of Queensland before 4pm on Monday the 30th of September 2024.
