NOTICE OF INTENTION TO SEIZE AND REMOVE ABANDONED PROPERTY

Transport Operations (Marine Safety) Act 1994, section 175A


Date of notice: 9th April 2025.

I, Nathan Bristow, am appointed as a Shipping Inspector under part 13 of the Transport Operations (Marine Safety) Act 1994 (the Act).

Description of abandoned property:

12m Vandestat Caribbean, Full cabin steel sailing vessel, Windigo, PY074Q, known to MSQ as Collector ID 233562. The ship overall appears to be in sound condition with slight superficial damage on the starboard side hull.

Where and when abandoned property was found:

Aground and stranded at the entrance to Tingalpa Creek on 17th March, 2025.

Position LAT: S27.4732° LONG: E153.1964°

I reasonably believe that ship Windigo PY074Q is abandoned property.

A statement that the abandoned property was immediately seized and removed:

The ship Windigo PY074Q was immediately seized and removed because it may become a hazard to ships or navigation and may cause damage to the environment.

Information about the place to where the abandoned property has been removed:

The ship Windigo PY074Q has been taken to New Farm Park MSQ Enforcement Buoy where it is currently stored.

Statement for the purposes of section 175A(5) of the Act:

If the property described above is not claimed by the 7th May 2025, I may, having regard to the value and condition of the property and without further notice–

(a) sell the property by public auction; or

(b) destroy it.

If you wish to assert ownership in the property described above, you must attend in person at the MSQ Pinkenba at 819/839 MacArthur Ave East Pinkenba in the State of Queensland before 4pm on 7th May 2025.
