NOTICE OF INTENTION TO SEIZE AND REMOVE ABANDONED PROPERTY

Transport Operations (Marine Safety) Act 1994, section 175A(3).

Date of notice: Friday 27 September 2024

I, Anthony ALBACK, am appointed as a Shipping Inspector under part 13 of the Transport Operations (Marine Safety) Act 1994 (the Act).

Description of abandoned property:

Collector ID182849 - The houseboat submerged weather deck completely at high tide – 10 metre full cabin aluminium houseboat, FRP and composite/plywood unpowered and unregistered vessel.

Collector ID183810 – the cuddy cabin weather deck completely submerged at high tide – black/grey 4.7 metre cuddy cabin aluminium speedboat with 90hp Yamaha outboard resting on seafloor, expired registration LLM36Q.

Where and when abandoned property was found:

  • Maritime Safety Queensland was alerted to the flooded vessels on 5 September 2024, however the vessel was known to be on the shoreline since early June 2024.
  • The vessel is grounded by the starboard bow at low tide mark with the weather deck fully submerging on high tides off the southern shoreline of Carter’s Basin adjacent, in the intertidal zone and is breaking apart with damage to the marine environment evident through structures and debris littering the seafloor astern of the houseboat.
  • The vessels may deteriorate further, break apart, and debris may pose as a risk to the safety of navigation of ships transiting the area and the marinas and wharves immediately adjacent.
  • I reasonably believe that both vessels are abandoned property.

When abandoned property may be seized and removed:

If the property described above is not claimed by 4 pm Friday 1 November 2024, it may be seized and removed from Queensland waters to a place on land determined by Maritime Safety Queensland.

Statement for the purposes of section 175A(5) of the Act:

If no one claims the property within the time stated above and I seize and remove it, I may, having regard to the value and condition of the property and without further notice–

(a) sell the property by public auction; or

(b) destroy it.

If you wish to assert ownership in the property described above, you must attend in person at the Maritime Safety Queensland, Gold Coast at 40-44 Seaworld Drive Main Beach in the State of Queensland before 4 pm on Friday 1 November 2024.
