NOTICE OF INTENTION TO SEIZE AND REMOVE ABANDONED PROPERTY

Transport Operations (Marine Safety) Act 1994, section 175A(3)

Date of notice: Friday 4 April 2025

I, Marita Ferguson, am appointed as a Shipping Inspector under part 13 of the Transport Operations (Marine Safety) Act 1994 (the Act).

Description of abandoned property: Collector ID 21798

The 8-metre fibreglass sailing sloop is without an engine, stranded and likely holed above and below the waterline flooding with the tide. No identifiers are visible on the sailing sloop and the Shipping Inspector is unable to identify an owner.

Where and when abandoned property was found:

  • The sailing sloop was first reported to Maritime Safety Queensland on or about Saturday 8 March 2025. Marine Officers located the sailing sloop on the northern shoreline of Karragarra Island on the 13 March 2025.
  • The sailing sloop was found unlit with an anchor light.
  • The sailing sloops accommodation space is inundated with water on high tide and full of a muddy silt.
  • The sailing sloop is not fitted with an engine and has no means of propulsion.
  • The sailing sloops fibreglass hull is likely holed, and the hull may deteriorate further, break apart and debris may pose as a risk to the safety of navigation of ships transiting the area.

I reasonably believe that the 8-metre sailing sloop Collector ID21798 is abandoned property.

When abandoned property may be seized and removed:

If the property described above is not claimed by close of business 4pm on Friday 2 May 2025, it may be seized and removed from Queensland waters to a place on land determined by Maritime Safety Queensland.

Statement for the purposes of section 175A(5) of the Act:

If no one claims the property within the time stated above and I seize and remove it, I may, having regard to the value and condition of the property and without further notice–

(a) sell the property by public auction; or

(b) destroy it.

If you wish to assert ownership in the property described above, you must attend in person at the Maritime Safety Queensland, Gold Coast at 40-44 Seaworld Drive Main Beach in the State of Queensland by 4pm on Friday 2 May 2025.
