The above mentioned Application has been made under Section 32(6) of the Act to cancel the notification ‘easement affecting the land shown so burdened in vol 5880 fol 71’ (‘Easement’) on the basis that there is no evidence that the Easement has been formally created. The Easement sought to be cancelled is a prescriptive easement recorded on Folio Identifier B/359735 being the land known as 88 Meehan Street Yass NSW 2582 and is owned by the Applicant. We intend to register the Application and cancel the recording of the Easement from Folio Identifier B/359735 unless, within one (1) month from the date of this notice, you lodge at this Office, an Order of Court from the Supreme Court of NSW preventing the registration of the Application and the removal of the easement.
