NOTICE PURSUANT TO SECTION 12A AND 32(6) OF THE REAL PROPERTY ACT 1900 ('ACT') CANCELLATION OF EASEMENT FOR DRAINAGE OF WATER
Notice is being given pursuant to section 12A of the Act that the Registrar General intends to exercise the power under section 32(6) of the Act to cancel the recording of Easement for Drainage of Water DP1248522 (‘Easement’) shown designated (E) in DP1248522. The Easement sought to be cancelled:
1. affects the land in Folio Identifiers:
• 3/1277567, in the vicinity of Wylde Street Marsden Park NSW 2765;
• 3485/1290477 known as 13 Wylde Street Marsden Park NSW 2765;
• 3486/1290477 known as 151 Barrallier Drive Marsden Park NSW 2765;
• 5/1270086 being part of Clydesdale Farm Road Marsden Park NSW 2765;
• Lots 3503 and 3513-3514 in DP1301072 in the vicinity of 3 Barrallier Drive Marsden Park NSW 2765; and
• Lots 7001-7138, 7140-7145 and 7147-7149 in DP1284227, lots 7300-7318 and 7319-7320 in DP1284229, lots 7201-7230 in DP1284228, being within the area bounded by Clyesdale Farm Road, Bakehouse Avenue, Bolwarra Drive and Richmond Road Marsden Park NSW 2765;
2. benefits the land in Folio Identifiers:
• lots 1002-1016, 1020-1129 in DP1254249, lots 1201-1269, 1271-1336 and 1338-1356 in DP1254250, lots 100-101 in DP1278707, lots 101, 102 and 109-130 in DP1268815, lots 1-2 in DP1286205, lots 1-2 DP1281248 contained within the area bounded by Clydesdale Farm Road, Bakehouse Road, Parkway Drive and Bolwarra Drive, Marsden Park NSW 2765; and
• 1/1270086 in the vicinity of Clydesdale Farm Road and Richmond Road Marsden Park NSW 2765
We intend to cancel the recording of the Easement from the Folio Identifiers unless, within one (1) month from the date of this notice, you lodge at this Office, an Order of Court from the Supreme Court of NSW preventing the registration of the removal of the easement created by DP1248522.
