APPLICATION FOR CANCELLATION OF ABANDONED EASEMENT AU627017 BY ANGLICAN SCHOOLS CORPORATION
The above mentioned Application has been made under Section 49 of the Act to cancel the recording of a Right of Carriageway 5.635 wide created with registered deed BK 1209 NO 212 (‘Easement’) due to abandonment. An easement may be treated as abandoned if it has not been used for at least 20 years.
The Easement sought to be cancelled:
1) affects the land in Folio Identifiers 103/1178849 (being 7 Murphy Lane, Orange, NSW 2800) and 201/1276846 (being 38 Hewitt Close, Orange NSW 2800) owned by the Applicant; and
2) benefits the land in Folio Identifiers:
(a) 11/631621 (being 21 Gorman Road, Orange NSW 2800);
(b) 103/1178849 (being 7 Murphy Lane, Orange, NSW 2800); and
(c) 1/790630, 64/815415, 66/817690, 69/1004166, 101/1174806, 102/1178849, 201/1276846 and 200/1276846 (respectively being 13, 14, 19, 24, 29, 34, 38 and 48 Hewitt Close, Orange NSW 2800).
NSW Land Registry Services intends to register the Application and cancel the recording of the Easement from the Folio Identifiers listed above unless, within one (1) month of the publication of this notice, we receive:
(i) evidence (by way of statutory declaration) showing that the Easement has been used in the last 20 years. Please note that all statutory declarations and submissions that are lodged in objection to the Application will be treated as publicly accessible and will be disclosed to persons upon request; or
(ii) lodge with NSW Land Registry Services, pursuant to section 74F of the Act, a caveat prohibiting the granting of the Application, accompanied by the prescribed fee (currently $171.70).
