Notice of acceptance
Enforceable undertaking under part 11 of the Work Health and Safety Act 2011
On 20 January 2021, a Metroll Queensland Pty Ltd (Metroll) worker was injured while assisting in the operation of a purlin mill at one of their worksites.
It was alleged that on the day of the incident Metroll, having a health and safety duty under the Work Health and Safety Act 2011 (WHS Act), failed to comply with that duty contrary to section 32 of the WHS Act.
This notice acknowledges acceptance of an enforceable undertaking (EU) given by Metroll as an alternate enforcement measure for the alleged contravention.
Metroll’s commitments within the EU include:
• disseminating information about the EU to specifi ed stakeholders
• installing and implementing an Integrated Ramp Switch on fi ve purlin mill outfeed tables
• purchasing, installing and implementing an automated purlin stacker on one purlin machine, designed to operate in conjunction with the Integrated Ramp Switch. If successful, the remaining purlin mills will be progressively retrofi tted with stackers
• undergoing three third-party occupational health and safety management system audits over the life of the undertaking • engaging a third-party plant safety specialist to conduct a risk assessment on all plant at a selected site, with recommendations implemented and shared with all other sites
• undertaking a safety risk assessment survey to improve workplace culture and consultation
• implementing the participative ergonomics for manual tasks program
• engaging, consulting and supporting the election of health and safety representatives at each workplace
• sponsoring DC Plus Engineering to attend a national conference to present its Integrated Ramp Switch as a safety solution to the broader steel industry
• preparing and sharing a case study with relevant industry associations and industry journals on lessons learned, outcomes and reasons for entering into an EU
• fi nancially contributing to two separate entities to support mental health and assist with emergency accommodation for people escaping domestic violence or homelessness
• payment of recoverable departmental costs
