Notice to control activities or conduct in Gold Coast waters
Gold Coast Waterway Authority Act 2012, part 5, divisions 2 and 3
Authority
I, Peter Kleinig, Manager (Waterways), Gold Coast Waterways Authority (the Authority), am subdelegated by the Chief Executive Officer of the Authority under section 14 of the Gold Coast Waterways Authority Act 2012 (the Act).
Area and watercraft
1. This waterways notice (the Notice) applies to—
a) waters of the Broadwater generally north west of Carters Basin (the Event Area)
b) watercraft anchored, moored, left, navigating, or otherwise operating in the Event Area.
2. The Event Area is shown on Map A1-576-1, which forms part of the Notice.
3. The waters of the Event Area are within Gold Coast waters as defined under the Act.
Requirements
1. A person in charge of a watercraft must move the watercraft out of the Event Area before 6:00 am on Monday, 14 April 2025.
2. A person in charge of a watercraft must not enter into, anchor, moor, leave, navigate, or otherwise operate the watercraft on, waters of the Event Area before 6:00 pm on Friday, 13 June 2025.
Watercraft to which Notice does not apply
1. The requirements of the Notice do not apply to—
a) a watercraft owned by the State
b) a watercraft participating in, or involved with the conduct or control of, an aquatic event within the Event Area.
c) a watercraft approved in writing by the Authority.
Offence
A person to whom the Notice applies must comply with each requirement of the Notice, unless the person has a reasonable excuse.
A contravention of a requirement of the Notice is an offence against the Act, which carries a maximum penalty of 100 penalty units (currently $16,130) for an individual and 500 penalty units (currently $80,650) for a corporate entity.
A watercraft that is anchored, moored, left, navigating, or otherwise operating in waters of Event area in contravention of a requirement of the Notice is contravening property.
Effect
The Notice takes effect from 6:00 am on Monday 14 April 2025 and continues to have effect until 6:00 pm on Friday, 13 June 2025.
